College Worth? Essay

College is a place for higher education. Many people go there for further study every year. Meanwhile, plenty of people skip college or drop out of college. Sort of people believe college is not worth because it cost too much. Most people think college is worth because you will able to get a good job when you holding a degree. Yes, because being a college graduate can help you gain more than the money you spent to pay for college. College is worth it because you will have a better job and pay then you can support yourself and your family. College student debt grows year by year, which means many students are unable to pay back their loan because they drop out of college or unable to find a job that can help they pay for their loan. However, it is just an excuse for those who did not finish college. In fact, according the article â€Å"The (Non-Monetary) Value of a College Degree†, Elia Powers writes â€Å"In 2005, a person with a professional degree could expect to make $100,000 a year, compared with less than $32,000 for a high school graduate and $51,000 for a graduate of a four-year college† this means college graduate can make much more money than high school graduate. Also, in the article â€Å"College Student Debt Grows. Is It Worth It?† NPR Staff state â€Å"For students graduating this year, Kantrowitz estimates that their debt will be about $27,000† this means people mostly borrow about $27,000 for college. Assume you graduate from college and earn $51,000 every year. You can pay $500 monthly. Then your debt will be clear with 5 years. Of course if you are only high school graduate and earning $32,000 per year. You are not able to pay back the loan because the money is only support for your own life expenses. Although finishing college requires much effort and time, college is worth it because college can lead you to become a healthier person. Finishing college can help you to make healthier decisions. When you are in college, you are considering about yourself and your future. You will able to determine what is good for you and what is bad. As the article â€Å"The (Non-Monetary) Value of a College Degree†, Elia Powers mentions â€Å"Of those 25 or above, roughly 25 percent of people whose educations stopped at high school smoke, compared with 10 percent of those who earned a bachelor’s degree or higher,† this means people who are college graduate most likely quit smoking or do not smoke. As we know smoking is a bad habit that will damage human health. So they made a healthy choice which is to stay away from smoking. Also at the same article above, Elia Powers said â€Å"for instance, more than 60 percent who were in the 25-34 age range said they exercised â€Å"vigorously† at least once a week. That’s compared with 31 percent of high school graduates who said the same.† This means 60 percent of college graduate exercise frequently so they can keep their body in health shape. We all know living in a healthy way is important because no one wants to get sick. Healthy is precious now because people realize health is our wealth. Although some factors may bother you going to college, college is still worth it because you will become a responsible citizen who can return to our society. The most important thing for a country is its citizen. The government needs money to run so we pay taxes and we can chose the best person to lead and improve our country. Then we can have a better life. In the article â€Å"The (Non-Monetary) Value of a College Degree†, Elia Powers states â€Å"Forty-three percent of those surveyed with at least a bachelor’s degree said they volunteered in 2006, and they reported doing so for a median of 55 hours.† This means college graduate people will more likely to serve for our society. This can make our environment better. Also, as â€Å"The (Non-Monetary) Value of a College Degree† Elia Powers mentions â€Å"In every age category, college graduates cast ballots at a higher rate than those who didn’t receive a diploma. The trend is particularly pronounce d for the 25- to 44-year-old group, in which 76 percent of college graduates voted, compared with 49 percent of high school graduates.† This means college graduate are also more willing to vote too. They want to be involved in the election. This is good for the democracy of the country. We all deserve the right to enjoy the facility of our country; however, we have the duty to serve our country too. College can make you become a good citizen who can improve our society. College is worth it also because it will build your personality and grow intellectually. Some people think college is a risky investment because if you are taking more debt, and unable to pay back afterword, you will be in big trouble. However, if you think more deeply about what else college can bring to you; you will see college can actually bring you more rewarding assets. In the online article â€Å"Is College worth it?† from PewResearchCenter, the Pew Social Trends Staff said â€Å"Among survey respondents who graduated from a four-year college, 74% say their college education was very useful in helping them grow intellectually; 69% say it was very useful in helping them grow and mature as a person; and 55% say it was very useful in helping them prepare for a job or career.† This means the things you experience and expect in college is different and difficult to train in the reality. While you became a smarter person, is there any cost you can trade in to become a knowledgeable man? Getting a degree is hard but the most important is the stuff you gained when you graduated from college. In this situation, we should try to encourage more people to get into college. People think college does not worth probably are not finished college. To persuade them is to get them into college and let them experience the changes leaded by college. I think government should lower the interest rates for college student loan so people can less consider the most common factors. Also the government can set up an alternative way to finish college like offer other type of degree which is easier to complete and government approved. Lets have people to realize that having a college education is important because this will improve the quality of our life and country.

Fearless

â€Å"Fearless† and â€Å"courageous†; two common words that have been used to describe soldiers for centuries. There is, however, a big difference between being courageous and being fearless. Courage is one of the best terms used to describe a soldier: that no matter how hard the circumstances are and how scared he/she is, they keep pressing on. It is truly amazing how courageous these men and women are. Humans were made to fear, it is humanly impossible to be without fear, there is no soldier that is truly â€Å"fearless†.Soldiers at war often put up a front that they are unafraid, the reason they put up this front is to be trusted by fellow soldiers, to fit into society's view of a soldier and to maintain their sanity. The world often perceives fear as a sign of weakness. The word fear is defined as a â€Å"feeling of anxiety or agitation caused by the presence or nearness of danger, evil, or pain. Extreme fear is terror which applies to an overwhelming often paralyzing fear† (Fear†). In the heat of battle, a soldier's senses are heightened to the danger that surrounds him.Any civilian in these circumstances would choose to run and hide or escape, but the soldier has been trained not to selfishly retreat, but to heed orders and advance. He/she may know his/her life is in grave danger, yet for the sake of courage and duty to his/her country he continues on. The courage that a soldier surrounds themself with is the quality of spirit which enables one to face danger or pain without showing fear. If a soldier falters he or she may be dismissed but will certainly not be trusted by his/her fellow soldiers.Each soldier desires trust, loyalty, and respect and each of their lives depend on it. The soldier makes a choice to lay his or her individual fears and emotions aside to be courageous. In the short story, â€Å"The Things They Carried†, by Tim O'Brien, not only were the physical items that they carried described but also the emotional burdens they carried. â€Å"They carried shameful memories. They carried the common secret of cowardice barely restrained, the instinct to run or freeze or hide. They carried their reputations.They carried the soldier's greatest fear, which was the fear of blushing† (O'Brien). Soldiers care about what fellow soldiers think of them. They need to be trusted. The face of fearlessness is formed to avoid being made a coward or being put to shame, and to keep a good reputation. Their fellow soldiers are all they have at war. In general, there is a disconnect between society’s view on war and a soldier’s view on war. Citizens are easily influenced and swayed by different means of communication in society.Society often portrays war and soldiers to be something that they are not: fearless. According to platoon leader, Paul Stanley, â€Å"soldiers realize the cost and effort required to be willing to fight and what it means to be in life or death situations , society thinks they understand but they don't† (Paul Stanley). He said his view is totally different than that of an everyday citizen. Lieutenant Stanley also commented on society’s negative view of soldiers; â€Å"Society believes soldiers are more like weapons instead of people. Sometimes society depicts soldiers in a negative light, as being merciless fighting machines, which is not the case either. Lieutenant Stanley said that his view of his country was better after war; he appreciates life more and is a better person. How society depicts soldiers is what we believe a soldier to be, which often means supernatural beings or war machines. In â€Å"The Things They Carried†, first Lieutenant Jimmy Cross, had gotten sidetracked during battle and because of it one of his men was killed.From then on Jimmy chose to put all thoughts outside of war aside in hopes that it would never occur again. He wouldn't show his emotion towards anything; in other words, he woul d act fearless (O'Brien 232-239). The feelings and emotions are still there, they are just hidden behind a wall, making it easier to keep him and others safe. Soldiers often need to block out any emotion and images to maintain their sanity. A first lieutenant in the Desert Storm War, Paul Stanley said â€Å"especially as an officer, you can't act scared.Everyone looks to you, so you have to be strong for them. † Soldiers have to have confidence in themselves and the team around them and also trust that they received the proper training. They learn to subdue their fear and cope with emotion. A common disorder that soldiers are diagnosed with after war because of their suppression of any emotional burdens is called Post Traumatic Stress Disorder or PTSD. Post-Traumatic Stress Disorder occurs when a person experiences a severe trauma or life threatening event.If soldiers were fearless, they wouldn't be affected by this disorder. Soldiers are heroes, courageous, noble, self-sacri ficing, and brave and so much more, but they are still human, they are not fearless. The aspect of being fearless plays a large role in keeping a soldier alive and sane. Their fearless attitude is the way soldiers are able to fit into society’s view of a soldier, be trusted by their team, and maintain their sanity.

Abolitionists opposed that position and fought for the exclusion of slavery from any territory absorbed by the United States. In 1847 the House of Representatives passed the Wilmot Proviso, stipulating that none of the territory acquired should be open to slavery. The Senate avoided the issue, and a late attempt to add it to the Treaty of Guadalupe Hidalgo was defeated. A major cause of conflict between the Southern slave states and the Northern free states was the lack of assistance given by northerners to southern slave-owners and their agents seeking to recapture escaped slaves. In 1850 Congress passed the Fugitive Slave Law. The law stated that in future any federal marshal who did not arrest an alleged runaway slave could be fined $1,000. People suspected of being a runaway slave could be arrested without  warrant and turned over to a claimant on nothing more than his sworn testimony of ownership. The Fugitive Slave Law brought the issue home to anti-slavery citizens in the North, since it made them and their institutions responsible for enforcing slavery. Even moderate abolitionists were now faced with the immediate choice of defying what they believed an unjust law or breaking with their own conscience and belief. The case of Anthony Burns, in which a fugitive slave was returned to slavery under the protest of 50,000 citizens of Boston, and the celebration of the abolitionist, Charles Sumners assault by Preston S. Brooks, fell under this statute. The Ostend Manifesto was a secret document written in 1854 by U.S. diplomats at Ostend, Belgium, describing a plan to acquire Cuba from Spain. The document declared that Cuba is as necessary to the North American republic as any of its present members, and that it belongs naturally to that great family of states of which the Union is the Providential Nursery. The aggressively worded document, and Soulà ©s advocacy of slavery, caused outrage among Northerners who felt it was a Southern attempt to extend slavery. American free-soilers, just recently stirred with the Fugitive Slave Law passed as part of the Compromise of 1850, decried the manifesto of brigands. Thus the American scheme to capture Cuba fizzled. Meeting in a Ripon, Wisconsin Congregational Church on February 28, 1854 some thirty opponents of the Nebraska Act called for the organization of a new political party and suggested that Republican would be the most appropriate name. The radicals also took a leading role in the creation of the Republican Party in many northern states during the summer of 1854 . While conservatives and many moderates were content merely to call for the restoration of the Missouri Compromise or a prohibition of slavery extension, the radicals insisted that no further political compromise with slavery was possible. In the following years, this anti-slavery party would gain many followers. By 1856 the Republicans had elected a Republican Speaker of the House of Representatives and placed a candidate in the election for president. In the Election of 1860, Abraham Lincoln would become inaugurated as a member of the Republican party, defeating John  Breckinridge, Stephen Douglas, and John Bell of the Southern Democratic Party, Northern Democratic Party, and Constitutional Union respectively. Dred Scott was an American slave who was taken first to Illinois, a free state, and then to Minnesota, a free territory, for an extended period of time, and then back to the slave state of Missouri. After his original master died, he sued for his freedom. He initially won his freedom from a Missouri lower court, but the decision was reversed by the Missouri Supreme Court and remanded to the trial court. Simultaneously, Scott had filed suit in federal court, where, after prevailing on the issue of his status as a citizen of Missouri, he lost a trial by jury. Scott appealed to the U.S. Supreme Court, which used the case to fundamentally change the legal balance of power in favor of slaveholders. The Court ruled that: 1. No Negroes, not even free Negroes, could ever become citizens of the United States. They were beings of an inferior order not included in the phrase all men in the Declaration of Independence nor afforded any rights by the Constitution. 2. The exclusion of slavery from a U.S. territory in the Missouri Compromise was an unconstitutional deprivation of property (Negro slaves) without due process prohibited by the Fifth Amendment to the United States Constitution. 3. Dred Scott was not free, because Missouri law alone applied after he returned there. The decision was a culmination of what many at that time considered was a push to expand slavery. The expansion of the territories and resulting admission of new states meant that the longstanding Missouri Compromise would cause the loss of political power in the South as all new states would be admitted as free states. Thus, Democratic party politicians sought repeal of the Missouri Compromise and were finally successful in 1854 with the passage of the Kansas-Nebraska Act, which naturally ended the compromise. Overall the reaction to the decision from opponents of slavery was fierce. Uncle Toms Cabin was the best-selling novel of the 19th century (and the second best-selling book of the century after the Bible) and is credited with both helping to start the American Civil War and helping to fuel the abolitionist cause in the United States. This era also marked a dramatic  increase in congressional representation for free states. Compared to the overall equality of representation in senate and minor favoring of free states in the House during 1813, an 1860 summation exhibits a vast tip in the scale for free states over slave states. An unfair congress meant anger and conflict in the unaffiliated south, as well as future secession. At the advent of the mid-1800s, the Union faced perilous difficulties that seemed only to be solvable by war. By 1861, Civil catastrophe was inevitable, and the differences that initially split the nation soon engulfed it. Conflicts including the Mexican War, the Wilmont Provisio, the growth of the Republican Party, the Dred Scott Decision, the Brooks-Sumner Incident, the Anthony Burns Incident, the Ostend Manifesto, Uncle Toms Cabin, and unbalanced congressional representation contributed to national dispute and eventual dissemination of the state.

Report on Multi User Operating Systems Essay Resources Sharing Concepts of Resource Sharing A multi user operating system can support more that one user at a time, this means that multiple users can share the same system resources simultaneously. The users of a multi user operating system can share both hardware and software resources, the operating system carries out complicated routines to manage all the processes that the users are running. List of shared resources: * Hardware CPU Power, RAM, Hard drive, Peripherals (printer, Scanner, CD ROM) Other peripherals may be made available in a MUOS for users who require them (Floppy disk drive, Speakers, Head Phones, Video Cameras etc. ) * Software Scheduler Software (needed to manage and prioritise tasks). Batch Job Some processes take a long time to complete and can often disturb other computer tasks that are important. A Batch Job is a file that does not require any user interaction, so it is set up to run a number of processes at a later time, often late at night. One example is overnight maintenance at a bank when they update all the accounts so it will not disrupt the other processes during the day. Multi-Tasking Concepts of multi-tasking Multi tasking is when the operating system switches between tasks at a very high speed, it can sometimes seem as though it is performing more than one task at a time. For example, a user could be printing and typing at the same time, and listening to a CD. Many users can access the same resources at (what appears to be) the same time. One disadvantage of this is that it requires a great deal of memory and the processes may run slower. The two types of multi-tasking are co-operative and pre-emptive: * Pre-emptive This is when the applications are forced to give up the CPU after a certain length of time so that the other processes get an equal share of CPU time. (time-sliced). * Co-operative multi-tasking is when it is the current running tasks responsibility to share the CPU to the other processes. One task must finish before the other starts. It is called Co-operative because all the tasks must co-operate for this type of processing to work and there is no time limit on each task. (Round Robin). Advantages / Disadvantages An advantage of Pre-emptive multi-tasking is that some important tasks may be allocated a more time slices so it will not be stalled by other smaller tasks. A disadvantage of both types of multi-tasking is that it requires a large amount of memory to work properly. Background Processing Concepts of background / foreground processing When a task will require a long time to process and requires no user input e.g. downloading a large file from the internet, it can be processed later when the computer is not processing other tasks. Background processing is often used in banks and businesses to process the customers accounts at the end of each day, the operating system can be left to run the process overnight or when the CPU is not currently being used by a task that requires a great deal of processing. Unix command to run background processing Control-Z = Leave process running in background bg = Continue process at background Control-C = move foreground process to background Fg = move the process to foreground Example of a background process If you need to run a large print job, e.g. printing out one hundred copies of a Workbook for a group of students, it can be set as a background process and will only use CPU power when other tasks are not running. Types of Multi-User Operating System Multi-Processor More than one CPU Multi user operating systems can sometimes have more that one processor. In some expensive operating systems it is possible to connect more CPUs to the system and have them work together to execute tasks. Multiprocessing can significantly reduce the time taken to execute each process. An operating system with multiple processors can perform different tasks separately or a task can be split up and processed by different CPUs. Advantages / Disadvantages An advantage is that multi processing systems can be very speedy at completing tasks. A disadvantage is that this type of system is very expensive. Time-Sliced As multi user operating systems share resources, different processes can require different amounts of time. It is possible and to interrupt a large process so that a smaller process to be completed. If you were using a time slicing system then the processor will switch between processes at timed intervals (Pre-emptive). The amount of time allocated to each process is called a time slice. The length of time given for each time-slice is allocated by a program called a scheduler. An advantage is that larger or more important processes may be given more time slices than a smaller task so it can be completed, however this could also be a disadvantage if there are many users executing smaller tasks as they will take longer to be finished. Distributed The distributed system is where a number of systems are connected through a Local Area Network. This can be more powerful than a single processor system and it is capable of online sharing. Hardware Components Processor The CPU is the brain of the operating system. It responds to and processes and instructions that control the computer. The control unit in a CPU controls everything which happens within, the ALU does calculations and is responsible for decision making and the accumulator stores the last data that was decoded for future processes. There are various registers within the CPU, they are the instruction register, which holds the instruction that is being decoded, the program counter stores what part of the program we have reached, the memory address register points to the location where data is being fetched or written and the memory data register is a storage area for data that is currently being transferred between the memory and the CPU. The Fetch-Decode-Execute Cycle has three important stages. * FETCH The CPU collects an instruction from the RAM * DECODE The control unit figures out what to do with it. * EXECUTE The instruction is carried out The speed of an FDE cycle depends on how fast the processor is (the length of time it takes for the signals to be sent to the control bus, and how many T-cycles each assembly instruction takes to execute. Memory Random Access Memory is sometimes known as main memory. RAM is volatile, which means it loses all the stored information when the power is cut off. Some computers also use virtual memory, which is stored in the hard drive but acts like RAM, this is much slower than physical memory. Another type of memory is Read Only Memory (ROM) which can be written to but cannot be erased. Data Storage Devices Floppy disk can be written to and erased, 1.44Mb CD ROM Can be written to but not erased, 700Mb Hard Drive stores many Gigabytes, can be written to and erased Zip Drive can be written to and erased, 100 250Mb Terminals Dumb Terminal A dumb terminal has no processing capabilities as they have no memory or processor of their own, it has only a monitor, keyboard and mouse. They are connected to a central processor. Intelligent Terminal An intelligent terminal contains memory and a CPU and is a standalone device. It only has to connect to the central processor when needed. Command to find terminal type terminfo Input / Output Devices Dumb Terminal Input keyboard and mouse. Output monitor, printer, speakers Software Components Kernel The Kernel is the heart of the operating system, the lowest level or the central part. Communication with the hardware is through the kernel. In multi user operating systems it is the kernels job to keep each process and user separate and to organize access to the system hardware, including CPU, memory, disk and other I/O devices. Device Handlers A device is any piece if hardware that is used in an operating system. A device handler is a piece of software within the operating system that communicates with the devices and tells them what to do. This is part of the operating system that is responsible for servicing requests of the device request queue. Spoolers (Simultaneous peripheral operations on-line) Spooling is used when data is waiting to go to an output device after it has been processed. The data is placed into a queue so that the CPU can process something else instead of having to slow down to the speed of the output device. Spoolers are used on mainly old devices e.g. old printers that can only handle one job at a time User Interface This is how the user can view the data within the operating system. The main types of user interfaces are; the graphical user interface e.g. Windows and Command driven interface e.g. MS DOS and standard UNIX. The CDI was more complicated to use than a GUI as you would have to know certain commands to do very basic tasks. Mutual Trust and Confidence (MTC) in an Employment Contract Sophie Canning   Mutual trust and confidence (MTC) is a central term in implied terms of an employment contract.[1] MTC is an implied term which dictates that the employer will not conduct himself in such a way as to destroy or seriously damage the relationship of confidence and trust between the employer and employee.[2] The common law development of MTC was influenced by legislation,[3] statutory procedure for unfair dismissal and also had an impact on the way judges view MTC. The foundations for the implied term of MTC were laid down by Addis v. Gramophone Co. Ltd[4] which set out that in wrongful dismissal cases, there was no compensation in common law action for 1) the manner of dismissal, 2) the injured feelings, or 3) losses sustained from post dismissal.[5] The notion of MTC was not established in this case, but this case later helped explore the implied term of MTC. Courtaulds Northern Textiles Ltd v Andrew[6] gave MTC a narrative formulation.[7] MTC also arose out unfair dismissal and constructive dismissal claims, where the claimant wished to establish constructive dismissal and had to show there had been a breach of contract.[8] However, this could not always been proved and therefore there was a shift and people started arguing the employers behaviour undermined the employment relationship.[9] The term of MTC was formally recognised in Malik v. BCCI,[10] where it was described it as a portmanteau obligation by Lord Nicholls[11] and also opened u p the opportunity to claim damages for undermining MTC.[12] Malik[13] ultimately contradicts the third limb in Addis[14] as it allowed compensation for stigma damage. The second limb from Addis[15] was also challenged in Gogay V Hertfordshire County[16] when a care worker was suspended following accusations of child abuse and, from this, suffered from a psychiatric illness. The care worker was awarded damages for the breach of MTC; going against Addis[17] which stated there was no remedy at common law for injured feelings. However, both Addis[18] and Malik[19] arose from claims during the course of employment. The question arises whether there can be a common law remedy for at the time of the dismissal. This is answered in Johnson v Unisys[20] where it was identified that in the common law of wrongful dismissal, there cannot be a remedy for a breach of MTC at the time of dismissal. This rule was fashioned into the Johnson Exclusion Zone which is where common law claims based on a breach of MTC were pre-empted by the statutory claim for unfair dismissal.[21] Some academics have showed contention towards the Johnson Exclusion Zone. Collins highlights that, in regard to unfair dismissal claims, the exclusion zone cannot be manoeuvred around, if the claim can be met by the statutory law of unfair dismissal or if the claim cannot be met by statutory law, the exclusion zone still applies.[22]It was also stated in Edwards v Chesterfield Royal Hospital NHS Foundation Trust[23] that the Johnson exclusion area h as been productive of anomalies and difficulties.[24] Furthermore, more recent cases such as Bournemouth University Higher Education Corp v Buckland [25] and Tullett Prebon Plc v BGC Brokers LP[26] have confirmed how fundamental MTC is, especially in the eyes of the court.[27]Buckland[28] demonstrated that apart from Johnson,[29] the statutory context of MTC cannot be invoked to dilute the impact of the common law regime.[30] Furthermore other cases have developed the law, in regard to constructive dismissal cases. Leeds Dental Team Ltd v Rose,[31] in consideration of Tullett,[32] required Tribunals to endeavour to find the employers intention; whether they had the intention to act in such a way as to destroy MTC with the intention to permit the employee to terminate the contract.[33] The values of public law have also had a role in the emergence of MTC. MTC aims to guard against an abuse of power by the employer and protects the employee from an imbalance of power and an undermining of the relationship, mirroring the public law principles of regulating the power of public bodies. Brodie highlights this, underpinning that the most notable impacts of the implied obligation has been the way in which it has restricted an employers discretionary powers public law also serves to regulate the powers and discretions of public bodies.[34] MTC also mirrors the values of public law as, as decided in Johnson,[35] the employers power to dismiss is unfettered by implied duty. The rationale for this, as highlighted by Barmes, is that judicial imposition of fetters on dismissal powers would unconstitutionally undermine the legislative prohibition on unfair dismissalà ¢Ã¢â€š ¬Ã‚ ¦ it would give a common law cause of action to claimants who had been excluded by Parliament from el igibility to bring a statutory claim.[36] Again, this stops an imbalance of power and an autocratic relationship between employer and employee. Natural justice also plays a role in MTC. Natural justice demands fairness and non-bias decisions and is a common law rule.[37] Natural justice fits in with MTC as there is an obligation of MTC that renders illegitimate decisions and behaviour adjudged to be unacceptable in the modern workplace,[38] trying to create a fair balance between the employers and employees. However the notion of natural justice within MTC is not entirely favoured. Neuberger stated that he does not consider it right to import the rules of natural justice, which are connected with judicial decisions and some administrative decisions, into the purely contractual relationship of employer and employee.[39] Although the notion of MTC is one which is instrumental to the employment contract, it does have limitations. Firstly, MTC is arguably too broad, it encompasses too many obligations. MTC was described as being an overarching obligation implied by law as an incident of the contract of employment.[40] However academics such as Cabrelli disagree with this statement and postulates that there is no evidence for the emergence of the implied duty of mutual trust and confidence as an umbrella principle.[41] Conversely, the broad nature of MTC could be considered a positive aspect. Irving maintains that MTC is a flexible and fundamental concept, is likely to retain its importance whilst evolving further with the changing nature of employment relationships.[42] The flexible of this term means it can change with and adhere to the needs of society. The Court of Appeal has sought to reduce the extensiveness of MTC.[43] In Johnson[44] injury arising dismissal was removed the overarching feature of MTC, although this did not extinguish its input when assessing damages.[45] Despite that this was removed from the extensive list of things MTC encompasses, the removal of this is also a limitation. The principal that came from this is called the Johnson exclusion zone and is a limitation as it does not allow employees to recover damages for injuries sustained from the way they were dismissed even if it ;rongful or unfair. Lord Nicholls identified three problems from this; 1) a duplication of proceedings, one for common law action and the other for statutory action, 2) the existence of a boundary line means that in some cases an ongoing course of conduct may have to be split, 3) boundary lines may cause strange results.[46] MTC, and the search for a boundary line in the Johnson exclusion zone, has also created tension between the common law and the statutory procedure. This was highlight in Eastwood,[47] where it was underpinned that the practical consequences of the boundary betwe en common law and statutory rights and remedies are unsatisfactory and merit urgent attention by the Government and the legislature.[48] There seems to be similar view from the judiciary concerning MTC. Lord Hoffman underpins that the statutory scheme of unfair dismissal does not allow parallel law development, as it would agonistic to Parliaments intention, and therefore further development of MTC would be impossible.[49] Brodie highlights that the view of the judiciary is that the appropriate mechanism for regulation is provided by the law of unfair dismissal; hence restricting the proper ambit of the term of mutual trust and confidence.[50] Brodie also underpins that not allowing statutory compensation limits to circumvent Parliaments intention has a wider public interest, and is not just about equitable remedies.[51] So on this; it seems that the courts view on MTC is that it should keep well within the ambit of Parliaments intentions, however in doing so, could prohibit the development of MTC. To conclude, it is therefore clear that the evolution of MTC has been influence by unfair dismissal legislation and Parliaments intention and has ties with Public Law values such as natural justice. The Johnson Exclusion Clause has brought with it a lot of limitations as well as the statutory procedures which limit the common law remedies and arguably MTC from further developing fully. Furthermore, the judges seem to be more concerned with providing a remedy in line with Parliaments intention rather than providing a common law remedy that is equitable which also could arguably be limiting the development of MTC fully and properly. However, generally there cannot be a variation of terms unilaterally. Lord Justice Asquith stated on the matter of unilateral changes, that [a]n unaccepted repudiation is a thing writ in water[52] underpinning the need for a bilateral variation of terms. JELs right to change contents of the handbook and policies is analogous to Bateman v Asda[53]where Asda created an express term in the employees contracts that stated they reserved the right to change and amend their handbook unilaterally. Both the courts agreed that Asda could reserve the right to change the handbook unilaterally as long as the term is clear and it is not unreasonable manner so far as to breach the term of mutual trust and confidence. Therefore following this, JEL has the right to amend the handbook, however changing the handbook to incorporate ran dom full body searches could be seen as unreasonable and a breach of mutual trust and confidence. S95 of the Employment Rights Act 1996[54] (ERA) underpins the nature to which someone can be dismissed. An employee can be dismissed with or without notice if the contract has been terminated by the employer.[55] Commonly the dismissal is not effective until has been communicated by the employer and the employee had acknowledged it, as confirmed in Gisda Cyf v Barratt.[56]The verbal dismissal from Jeremy can be seen as being communicated and therefore it can be said that Lizzie acknowledged it. The dismissal must also be clear and explicit. If it is ambiguous the courts must enquire as to what the reasonable man would understand as a dismissal. In Futty v D and D Brekkes Ltd[57]the employer told the claimant if you do not like the job, you can fuck off and this was construed by the claimant as being equivocal to a dismissal. However, this was not construed as a dismissal but as a resignation as the complainant found another job. It also has to be established whether Lizzie can claim for unfair or wrongful dismissal. Wrongful dismissal is concerned with a dismissal in breach of contract. There are two conditions that need to be fulfilled to have a successful claim; 1) there was a termination of a contract without or with inadequate notice and 2) the employer was not justified in doing so.[58] On the other hand, unfair dismissal is concerned with a dismissal that is unfair and is statutory. Under the ERA it states that [a]n employee has the right not to be unfairly dismissed by his employer.[59] To claim for unfair dismissal, there must be a qualifying period of employment of at least one year, as her employment is prior to 6 April 2012.[60] As Jeremy had no good reason for dismissing Lizzie, or followed a disciplinary process, it can be seen as unfair.[61] There are aspects of Lizzies dismissal that were wrongful and unfair. Generally, the law on references is that there is no legal obligation to provide a reference; but if one is given it must be fair.[62] If Lizzie were to think the reference was unfair, she could claim for damages upon proving the unfair reference caused her to suffer a loss.[63] Jeremy stating not to bother asking for a reference was therefore neither unfair nor wrongful as Jeremy does not have to provide one. At common law, no damages can be awarded for matters that arise from it such as psychiatric injury. Lizzie has suffered panic attacks and depression since her dismissal. This is indicative of wrongful dismissal. However, the courts cannot award damages in regard to psychiatric injuries that arise as a result of the dismissal, as per Johnson v Unisys.[64]In this, the claimant had won a claim for unfair dismissal and tried to claim for wrongful dismissal, as the claimant had suffered a mental breakdown as a result of the way he was dismissed. However, the majority verdict was that there could be no claim as the judges could not justify developing a common law remedy to employees who suffered from psychiatric illnesses as a result of the way they were dismissed. Johnson[65]indicates that the judges are not prepared to extend the common law of wrongful dismissal in a way which would extend beyond that of unfair dismissal legislation.[66] However, as per Eastwood v Magnox Electric Plc[67] Lizzie could have claimed if the psychiatric injury arose before the dismissal; but this is not the case, so it is unlikely she could claim for psychiatric injury. Additionally, in Lizzies employment contract, it was an express term that she would receive 3 months notice. However Jeremy did not satisfy this and terminated her employment without notice. Under S86 ERA there is a statutory minimum notice period.[68] For each year of employment, there must be one week of notice; if the employment is continuous and more than two years but less than twelve.[69] Therefore, under this statutory minimum, Lizzie should be entitled to at least five weeks notice. However, Lizzies notice period was contractually 3 months and as she has not received this, there has been a breach of contract. Therefore it could be said that Lizzies dismissal was in fact wrongful as this is a breach of contract. Generally, there is no duty to give notice when the employee is in fundamental breach of contract. This is shown in Pepper v Webb[70] where the employees refusal to follow instructions and continued to be insolent was held to be a breach of implied duty and therefore t he dismissal was warranted, despite there being no notice. Lizzie should claim for unfair dismissal. There are three types of remedies, in regard to unfair dismissal: reinstatement, re-engagement and compensation. Reinstatement is governed under S114 ERA and means an employer has to treat the complainant as if he had not been dismissed;[71] effectively when the employee goes back to their job as if they had not been unfairly dismissed. However, it is unlikely she would want this. Moreover, re-engagement is governed under S115 ERA which states that the complainant will go back to the employer but to a different job.[72] Again, it is doubtful she would want this. Additionally, compensation is governed by sections 118 to 124 ERA. S119 underpins the basic award received; 1) Half weeks pay for every year of employment when the claimant is aged under 22, 2) Weeks pay for work between 22-40 and 3) Week and a half pay for every year over 41.[73] The Compensatory award is governed by S113 and conditions that the court must give an amount that is equi table[74] and includes losses of earnings and any future loss, subject to aggravating circumstances, such as if the complainant had contribute to their dismissal in any way.[75] Damages are subject to deductions; one of the most common deductions is the Polkey Deductions.[76] This deduction occurs when there has been an unfair dismissal as the employer has failed to follow the correct procedure.[77] If the claimant would have been dismissed anyway, the compensation would be reduced as to the likelihood as a percentage deduction.[78] If Lizzie claims for unfair dismissal, it would be unlikely she could claim for wrongful as well. However, if she wanted to claim for wrongful instead, as it is concerned with the breach of a contract, the purpose of the remedy would to put the claimant back in a position they would have been before the breach. Damages in regard to the inability to comply with the express notice period can only stretch as far as the money earnt in that period of employment if notice had been given. This is highlighted in Focsa Services (UK) Ltd v. Birkett[79]where Justice Clark stated that the fact [was] that Mr Birkett was dismissed. In so far as he did not receive his full notice, he is generally entitled to damages to reflect the pay during the notice period and no more.[80] Lizzie did not receive a notice, even though it was contractual that she should have one and therefore Lizzie could claim for pay she would receive in those three months if she received notice. When the courts are analysing th e amount to give in damages, the court also have to consider other relevant factors such as bonuses. Lizzie, as part of remuneration, received a discretionary bonus and received this bonus ordinarily every year, bar last year. Generally, there can be a claim for bonuses if they are contractual, however as Lizzies was discretionary there is no duty to give a bonus if not contractual. Moreover, the courts aim to return the employee to the original position before the dismissal. This is fortified in Lavarack v Woods of Colchester[81]where an employee had been wrongfully dismissed and did not receive a bonus after dismissal, despite being subject to sporadic discretionary bonuses, as the employers had cut bonuses and raised the wage. The Court of Appeal held that the employers only had to fulfil the contractual obligation as everything else, including bonuses and raised pay, was discretionary. Metaphors of Society in One Flew Over the Cuckoo’s Nest and I Know Why the Caged Bird Sings In One Flew Over the Cuckoo’s Nest, Kesey's use of description and symbolism not only enhance the depth of the narrative, but they provide the reader with amazing insight into the character’s minds, hearts and souls. In fact, the characters themselves can be viewed as metaphors of society; not just the institution. R.P. McMurphy, for example represents the rebellious faction of society that was so loudly expressing itself during the sixties and seventies. He, like the hippies, challenges authority and brings about change by inciting others to rebel as well. He is both dynamic and crude, both funny and pitiable, as he rallies the other patients around him by challenging the dictatorship of Big Nurse. He encourages gambling in the ward, smuggles in wine and women and openly defies authority whenever possible. In the end, Nurse Ratched teaches him the ultimate lesson on authority, which could be seen as a warning against rebellion. His lobotomy is â€Å"the establishmentà ¢â‚¬  way of quieting the unruly protests of those brave enough to speak their minds. The character of Billy is also meant to show us that disobedience can have disastrous consequences, when the evil Nurse Ratched drives him to suicide. The Chief, who acts as the narrator, is a tall and strong Native American who pretends to be mute and deaf in order to protect himself from pain. His character is representative of the way society was very silent in the fifties until people finally couldn’t take it anymore and let their feelings be known with a vengeance. McMurphy rescues the Chief from his silence, and he returns the favor by rescuing McMurphy from life as a vegetable. Converse... ...the Brown v. Board of Education, Topeka case which struck down legal barriers to school integration. This was the first major success that black activists had enjoyed and it gave hope to the author that people really could make a difference when they were united, organized, and had justice on their side. It was in part, because of her enthusiasm about the outcome of the case that soon after the Supreme Court's Brown decision in 1954, Jo Ann Gibson Robinson wrote a letter to the mayor of Montgomery, W.A. Gayle, stating that "there has been talk from 25 or more local organizations of planning a city-wide boycott of buses." By 1955, the Women's Political Council, the same council who had previously be disinterested in Robinson’s plight, had plans for just such a boycott. I found this to be personally inspir ing in the sense that one person really can make a difference.

The Problem With Destroying Cliques to Deter School Violence :: Critical Thinking Essays

With all the recent incidences of school shootings and other acts of violence, school administrators all over the country are trying to think of ways to prevent such incidences from occurring at their schools. You, too, are probably faced with the concern of school-related violence and how to prevent it. Many school administrators are considering forcing students to sit with students who aren't in their group or clique, but is this actually a good idea? Will forcing students to sit with people they don't like and/or don't want to sit with actually help them to get along better, or will it encourage more violence towards persons of other cliques? I believe that more problems will be created than will be solved by following the proposed solution. First of all, the problem upon which we are deliberating involves the formation of groups in the school. To find a solution to a problem, you first must know the cause(s) and result(s) of the problem. There are many reasons as to why students form groups. One of the largest factors in the formation and choice of cliques is common interests. Students want to hang out with people who like the same (or similar) things that they do. For example, if there are two students in the school, and one likes sports and the other likes drama and art, they most likely won't get along well because they don't have anything in common. If two people have nothing in common, they will get bored if they hang out with each other since they won't be able to find anything that BOTH of them want to do. If you look at all the different groups in our school, most people in each one have something in common - the guys in the football clique all play football, the girls in the cheerleader clique all cheerlead, et c. Although most people who play the same sport or are involved in the same activities are in a group associated with that sport or activity, not everyone in that sport or activity is in that group. Often, these students aren't in the clique because they and the other people in the activity/sport have a major difference. A few such examples could be the middle school they attended or other interests they may have. Often, students who go to the same middle and possibly even elementary schools have already found some good friends and they want to stick with their friends in high school.

Censoring Our Students :: Argumentative, Legal Issues, Social Issues

â€Å"Students do not shed their constitutional rights to freedom of speech or expression at the schoolhouse gates.† --Justice William Brennan For many years it has been debated whether students have the same amendment rights as any other person in the world. Many would say that they do not. They would say that by taking away those state given rights they are protecting the students from being exposed to negative things. Unfortunately the only thing that is being accomplished by this overprotection is the lack of understanding of the world they will soon be facing. â€Å"Why not stand firm as a public institution that expresses and explores the complex range of human experiences? Why be diplomatic and apologetic about the fact that we do not shy away from difficult, challenging, and complex topics? (Durbin)† There isn’t a more appropriate statement. Why not stand firm? Prepare students for the real world. Teach them how to survive. By censoring out issues or only allowing limited discussions of high profile topics, students are not being exposed to life skills that are crucial to the real world. Therefore setting them up for failure.   Ã‚  Ã‚  Ã‚  Ã‚  The American public schools, for many years, have been faced with the problem of censorship. Many such problems have been fostered by groups who question the use of instructional materials that do not meet their moral, religious, political, cultural, or ethic values (Sherrow 38). By censoring topics such as homosexuality, religion, sex, racial issues, and other taboo topics it is not allowing the growth and expansion of student’s minds.

Frankenstein an early form of science fiction? Essay

† Many people believe that this was just an excuse for Victor’s mistakes, but I believe that it was Mary Shelley’s influence creeping into the storyline yet again. Shelley was a romantic; she spent her life against the facts of the world, hoping for the near impossible. She drove herself to the wonders of fate, much like Victor is doing at this time in the book. He told himself that he had little control, and that fate and mysterious wonders possessed him like a puppet on a string. Death is in a way the centre of the story. More then half of the characters themselves die, and the creature is made of dead matter. It is astonishing that Mary Shelley would write about death if she was a romantic. What is even more astounding is that she wrote so much about science! But I think there is a possible link that does not contradict any of the facts or motives. If Shelley wanted to prove how dreadful science was, then what could persuade people more then death? I think that she wrote the story to illustrate what science could really do to someone’s life. Whereas the â€Å"guardian angel† mentioned in the story (which I think is symbolic for the romantics Shelley loved), could have saved their lives. The death presented can be received as if it were a horror story, and it partially is, but the amount of death and pain suggests otherwise. Even though the idea of death is dire, without it the book would be pointless and boring. In fact, in this situation, the death creates life, the creature. â€Å"With an anxiety that almost amounted to agony, I collected the instruments of life around me that I might infuse a spark of being into the lifeless thing that lay at my feet. † Victor’s experiments with dead matter and electricity must also give a massive input to the concluding decision. It contains scientific knowledge, experience and language, and therefore helps the science fiction appeal. Even the way that Victor speaks sounds scientific enough to make you think that it’s science fiction. â€Å"I thought that if I could bestow animation upon lifeless matter, I might in process of time renew life where death had apparently devoted the body to corruption. † Although in the film certain parts of content are lost and an exaggeration of the electricity used is inputted, the outlines, structure and main plot remain. And if the film was defined as a sci-fi horror, then indubitably the book must also be regarded with similar merits. There are so many ways in which science is referred to in the book that it is almost impossible to imagine how many there actually are. If Victor as the main character is experimenting with science, then presumably the story is experimenting too, bringing to the conclusion that Frankenstein is an early from of science fiction, on the basis of the meaning of science fiction itself. Science fiction itself is defined as â€Å"a piece of fictional writing including a form of scientific knowledge or plot. † Therefore, theoretically Frankenstein would fall into this category. The only obstacle preventing this is whether or not it should be something else, like gothic horror or even romantic thriller. There are approximately equal amounts of evidence that would finally classify the novel. There are so many genres it could be that it is extremely difficult to comprehend which one it would distinctively fall into. The problem is how do we choose which one? But one thing most people do not consider is why can’t something be more than one thing? For years people have combined ideas to save time or just for the sake of it. Things like two in one shampoos, or multi vitamin tablets or even television programmes. So what some people agree upon in this situation is: why can’t Mary Shelley’s Frankenstein be three genres rolled up into one? After all, this essay has found no reason to suggest why it shouldn’t be pronounced science fiction, and I am sure that there will be no way to say how it is not any other genre. If we excluded one genre from the description then it would not fully describe the book to its full temperament. However, against anything else and for the sake of answering the original essay question, I will call it an early form of science fiction, only because there was nothing like it before it was written, and if it hadn’t been, there may not be a science fiction anyway. Symbolism in The Glass Menagerie

The Glass Menagerie, by Tennessee Williams is a short drama that uses a big assortment of symbolisation throughout to depict the emotional, physical and societal province of each of its characters. Liberated and society Essay

Some products portrayed women as the traditional housewife like ‘Shake ‘n’ vac’ does with their commercial. However the house used was fairly modern for the time as it had huge windows, which for the time were very modern and the furniture was better than the average shown in television programmes of the time, signifying a middle class house. However the woman in the advert is not middle class but she is portrayed as working class. The woman is portrayed as enjoying doing the housework and when the person purchases the product they too can enjoy doing the housework. During the period of the advert women were portrayed as being able to have a job but the majority were still in the house unemployed and cooking and cleaning. However throughout the large part of the twentieth century women were campaigning to be liberated and society did not agree with this at all. The liberation began in the early part of the twentieth century after the First World War between Christmas 1914 and 1918. The big push came in the nineteen sixties and women started to appear more in advertisements like in the Fairy Liquid advert in the mid-sixties. Women being liberated started a huge difference in the amount of advertising containing women. The graph below shows what happened to women in advertising and as you can see the amount of adverts which contain women steadily goes up.  From about the nineteen eighties onwards women were used as sex objects more unlike previously. For example Lucky Strike used a woman as an upperclass role model, something the men wanted to have and something the women wanted to be. However companies like Milk Tray use women in a more sensual and seductive way. For example when the lady walks out of the shower in a dressing gown whilst drying her hair and finds the box of Milk Tray on her dressing table. As opposed to the Oxo advert in the early nineteen eighties which showed the traditional Mother serving her husband and then later on feeding a whole family. Oxo’s adverts on television have always been long term campaigns, which started off with ‘Katie’ which lasted for eighteen years and then moved onto a family after surveys had been carried out. In the nineties women were used as sex objects to appeal to the male population for the majority of the time unless the product was obviously aimed at women. For example Wonder Bra used a woman to advertise their product however the advertisement may have also captured a small male audience because of the visual aspect of the advert. This is the same for the Round the clock panty hoses, which was unveiled in the late eighties. Many adverts made in the nineteen nineties recognised a niche in marketing when creating their adverts for their campaign, which was aimed at the male population. For example if an advertising campaign were to be aiming at men then they may appeal to their sexual weakness. This is what H(agen-Dazs has done, they have used a good-looking male to appeal to the women and they have used a good-looking female who happens not to be wearing much. The advert also has the hidden meaning of the product being a seductive ice cream. At present day there are many adverts on television usually aged between twenty to on average about thirty-five and also some adverts. Like the direct line car insurance advert for example, which used an over 40, middle class woman because it was the same age range as the advert was targeting. The majority of the adverts which use women without much on are normally found in magazines, which helps the producers to target their audience more effectively, also they have a fair idea of which age range may see them if in magazines instead of on the television. However this is not always the case because some companies may use channels on Sky or Digital which people have to pay for to watch, which again allows the advertisers much more accuracy in who they are targeting. Throughout the last century women in advertising has changed dramatically as well as the way in which advertising occurs through our daily routines. This is a change, which most probably will not stop. Women started off in the beginning of the century as being icons in which men aspired to have and who women aspired to be. Women then changed along with societies opinions and as wars were fought not just abroad but equality for women as well. This liberation led to women appearing more frequently in advertising and appearing more in the work place than they may have done twenty years before. I feel that women in advertising is a good thing because society is equal and therefore women are just as likely to purchase goods as much as men.

For those smaller departments it will be smaller due to fewer personnel on shift and tasks at hand. In the Unites States we have three different types of police departments local, state, and federal. In this paper you will find a brief description of all three. In the city of El Centro California we have a smaller department due to the population here in El Centro. El Centro Police Department was established in 1908 it involves 58 sworn officers and 26 civilian employees. The structure is made up of the Police Chief, Commanders, Lieutenants, Sergeants, field officers, and civilian employees. This department comprises of three sub-divisions patrol, traffic, and Crisis Response Unit. Patrol is in charge of patrolling the city and making police presence known. Traffic division handles city traffic and makes sure that residents and visitors alike are respecting all speed limits and traffic signals. Crisis Response Unit is a specialized unit that has been established to handle critical field operations. It manages sensitive calls such as those where negotiations are needed; it is also capable of deploying specialized units where highly trained officers are need. Investigations Division accounts for two sergeants, seven detectives, one community service officer, and a secretary. Four of the seven detectives are assigned to handle multi-jurisdictional narcotics enforcement and one detective is allocated to juvenile crimes. Evidence and property is controlled by the community service officer. The person responsible for the Investigation Divisions smooth operations is the division secretary. The Chief, Executive Commander, and Staff assistant lead the Administration Division. Police Chief Jim McGinley is the current chief for El Centro police department. Chief McGinley has 32 years of law enforcement practice; previously he served as Commanding Officer for San Diego Police Department. Prior to retirement in 2005 Chief McGinley headed the Investigations Divisions 2. Chief McGinley was in charge of elder abuse, auto theft, financial crimes, robbery, gangs, and homicide. California Highway Patrol was formed August 14, 1929. It consists of eight different divisions throughout California. Their structure is very similar to a military unit. At the top of its structure is the Commissioner which has the following offices under it Office of Special Representative, Office of Inspector General, and Office of Employee Relations. Deputy Commissioner follows with the Office of legal affairs, Medical Relations, and Equal Employment Opportunity. After that the structure branches of into two different components one being administrative and the other being the officers on the beat. Assistant Commissioner Staff has several departments like Administrative Service Division, Information management, Enforcement & Planning, Office of the Academy, Internal Affairs, Office of Employee Assistance & safety, and the Office of Organization Development. Assistant Commissioner Field is the other branch that I mentioned. This office also has various divisions and offices like Protective Service Division, Office of Air Operations, State Security Division, and all of it different patrol divisions in the state. The state is broken down into eight different divisions I will name them form southern California to northern California; Border Division, Southern Division, Inland Division, Central Division, Costal Division, Valley Division, Golden gate Division, and Northern Division. California Highway Patrol has two main missions the primary one is to make sure that all traffic and transportation along freeways and state routes. CHP officer still maintain police authority out of state route and freeways. CHP’s secondary mission is to aid and assist to any emergencies that exceed local capabilities. A federal police agency is the Drug Enforcement Administration (DEA) and it was founded in July 1973 formed by President Richard Nixon. He established this agency to combat the war on drugs and not only nationwide but worldwide as well. According to the Drug Enforcement Administration web page the DEA has nearly 5,000 Special Agents and a budget of $2.02 billion. The Administrations structure is very complex and consists of many different divisions. At the top of its enormous structure it has its Administrator and Deputy Administrator followed by five different branches forming the top of this structure. It has Executive Equal Opportunity & Employee Assistant Staff (ADE), Executive Policy & Strategic Planning Staff (ADS), Office of Administrative Law Judges (LJ), Office of Chief Council, and Office of Congressional & public Affairs. Drug Enforcement Administration has many other divisions and departments that they account for a whole thirty one of them to be exact with the last one being field operations. DEA has a much larger structure mainly because it not only fights the war on drugs and terrorism in the United States but it also must do it worldwide.
